Terms and conditions
GENERAL TERMS AND CONDITIONS FOR THE E-SHOP
This is an English translation of the Terms and Conditions provided for information. In accordance with these Terms, the Contract is concluded in the Slovak language and the Slovak version is legally binding.
These general terms and conditions (the "Terms") govern the rights and obligations of You, as the buyer, and Us, as the seller or trader, within contractual relationships concluded by means of distance communication, specifically through the E-shop on the website www.vervoshop.com.
All information on the processing of your personal data is contained in the privacy policy, which you can find at www.vervoshop.com/ochrana-sukromi.
As you surely know, we communicate primarily at a distance. Our Contract therefore also uses means of distance communication that allow us to reach an agreement without You and Us being physically present at the same time.
If any part of the Terms conflicts with what we have jointly agreed during the process of your Order on Our E-shop, that specific agreement shall take precedence over these Terms.

GENERAL PROVISIONS AND INFORMATION
Goods can only be purchased through the web interface of the E-shop.
When purchasing Goods, it is your obligation to provide Us with all information correctly, completely and truthfully. We will therefore consider the information you provided when ordering the Goods to be correct, complete and true.
Conclusion of the contract
The Contract with Us can only be concluded in the Slovak language.
The Contract is concluded at a distance via the E-shop, and you bear the costs of using the means of communication you use when concluding the distance Contract. These costs do not increase the Total price of the Goods and do not differ in any way from the basic rate you pay for using these means (i.e. in particular for internet access), so you need not expect any additional costs charged by Us beyond the Total price. By sending the Order, you agree to the use of means of distance communication.
In order for us to conclude the Contract, you need to create a draft Order on the E-shop. This draft must contain the following information:
- Information about the Goods being purchased (on the E-shop you mark the Goods you are interested in buying with the button "Order with obligation to pay");
- Information about the Price, Shipping price, VAT, method of payment of the Total price and the requested method of delivery of the Goods; this information is entered while creating the draft Order in the user interface of the E-shop, while the information about the Price, Shipping price, VAT and Total price is automatically stated by Us in the draft Order based on the Goods and delivery method you have chosen;
- Your identification details needed for us to deliver the Goods, in particular your name, surname, delivery address, telephone number and e-mail address;
- In the case of a Contract under which we will supply Goods to you regularly and repeatedly, also information on how long we will supply the Goods to you.
While creating the draft Order, you can change and check the data until the Order is created.
After checking, you create the Order by pressing the "Order with obligation to pay" button. Before pressing the button, however, you must confirm that you have read the Terms properly and that you agree with them, otherwise the Order cannot be created. A checkbox is used for this confirmation and consent. After pressing the "Order with obligation to pay" button, all the information you have filled in will be sent directly to Us.
We will confirm your Order as soon as possible after we receive it by a message sent to the e-mail address you entered in the Order. The confirmation will include a summary of the Order and these Terms. Our confirmation of the Order concludes the Contract between Us and You. The Terms in the version effective on the date of the order form an integral part of the Contract.
There may also be cases where we are unable to confirm your Order. These are mainly situations where the Goods are not available or where you order a larger number of pieces of Goods than we allow. However, we will always provide you with information about the maximum number of pieces of Goods in advance on the E-shop, so it should not come as a surprise. If there is any reason why we cannot confirm the Order, we will contact you and send you an offer to conclude the Contract in a modified form compared to the Order. In such a case, the Contract is concluded at the moment you confirm Our offer.
If an obviously incorrect Price is stated on the E-shop or in the draft Order, in particular as a result of a technical error, we are not obliged to deliver the Goods to you at that Price, even if you have received an Order confirmation and the Contract has thus been concluded. In such a situation, we will contact you without delay and we will be entitled to withdraw from the Contract, and we will send you this withdrawal together with an offer to conclude a new Contract in a modified form compared to the Order. In such a case, the new Contract is concluded at the moment you confirm Our offer. If you do not confirm Our offer within 3 days of it being sent, we are entitled to withdraw from the concluded Contract. An obvious error in the Price is, for example, a situation where the Price clearly does not correspond to the usual price at other sellers at the time the Order is created, or a digit is clearly missing from or added to the Price.
Once the Contract is concluded, you are obliged to pay the Total price.
If you have a User account, you can place an Order through it. Even in that case, however, you are obliged to check the correctness, truthfulness and completeness of the pre-filled data. The way an Order is created is the same as for a buyer without a User account; the advantage is that you do not have to fill in your identification details repeatedly.
In some cases, we allow a discount to be used for the purchase of Goods. To receive the discount, you need to enter the discount details in the designated field in the draft Order. If you do so, the Goods will be provided to you at a discount.
User account
Based on your registration on the E-shop, you can access your User account.
When registering a User account, it is your obligation to enter all data correctly and truthfully and to update it if it changes.
Access to the User account is secured by a username and password. You are obliged to keep these access details confidential and not to provide them to anyone. If they are misused, we bear no responsibility.
The User account is personal and you are therefore not entitled to allow third parties to use it.
We may cancel your User account, in particular if you have not used it for more than 1 year, after you withdraw from the Contract or if you breach your obligations under the Contract.
The User account may not be available continuously, in particular with regard to necessary maintenance of hardware and software.
Price and payment terms, retention of title
The Price is always stated on the E-shop, in the draft Order and in the Contract. In the event of a discrepancy between the Price stated for the Goods on the E-shop and the Price stated in the draft Order, the Price stated in the draft Order applies, which will always be identical to the price in the Contract. The draft Order also states the Shipping price or the conditions under which shipping is free.
The Total price under point 1.4 is stated including VAT and all fees set by special legislation.
We will ask you to pay the Total price after the Contract is concluded and before the Goods are handed over. You can pay the Total price in the following ways:
- By bank transfer. We will send you the payment details in the Order confirmation. When paying by bank transfer, the Total price is due within 7 days.
- By card online. In this case, payment takes place via the Shoptet Pay payment gateway and is governed by the terms of this payment gateway, which are available at: https://www.shoptetpay.com/sk/vseobecne-obchodne-podmienky-shoptet-pay/. When paying by card online, the Total price is due immediately.
- Cash on delivery. In this case, payment is made on delivery of the Goods against handover of the Goods. When paying cash on delivery, the Total price is due on receipt of the Goods.
We do not accept cash payments.
The Invoice will be issued electronically after payment of the Total price and will be sent to your e-mail address stated in the Order. The Invoice will also be physically enclosed with the Goods and available in your User account, if you have one.
Ownership of the Goods passes to you only after you have paid the Total price and the Goods have been delivered to you. When paying by bank transfer, the Total price is paid when the funds are credited to Our account; in other cases, it is paid at the moment the payment is made.
Delivery of goods, transfer of the risk of accidental destruction, accidental deterioration and loss of the subject of purchase
The Goods will be delivered to you in the way you choose, from the following options:
- Personal collection at Packeta pick-up points;
- Delivery via the carriers Slovak Post, PPL SK, DHL, Packeta.
The Goods can only be delivered within the Slovak Republic.
We are obliged to deliver the Goods to you without undue delay, but no later than 30 days from the date the Contract is concluded, unless we agree otherwise. The Goods are delivered at the moment you or a person designated by you take them over, or when we hand them over to a carrier commissioned by you outside the transport options we offered you. If the Goods require assembly or installation by Us, the Goods are considered delivered only once assembly or installation is completed. Goods with digital elements are considered delivered at the moment the relevant digital content or digital service is made available to you for download and installation, or, in the case of continuous supply of digital content or provision of a digital service over an agreed period, at the moment it starts being made available to you.
When performing the Contract, circumstances may arise that affect the delivery date of the Goods you have ordered. We will inform you without delay by e-mail of a change in the delivery date and of the new expected delivery date of the ordered Goods, without prejudice to your right to withdraw from the Contract. Our notification of the new delivery date will also include Our request for you to state whether you insist on delivery of the ordered Goods on the new date. In the case of personal collection at Our premises, we will always inform you by e-mail that the Goods are ready for collection.
When taking over the Goods from the carrier, it is your obligation to check that the packaging of the Goods is intact and, in the event of any damage, to report this to the carrier and to Us without delay. If the packaging is damaged in a way that indicates unauthorised handling and entry into the parcel, you are not obliged to take over the Goods from the carrier.
You are obliged to take over the Goods at the agreed place and time. If you do not take over the delivered Goods in accordance with the previous sentence, we will notify you by e-mail where you can collect the Goods, including the deadline for collection, or, based on your written request sent no later than 14 days from the date you were supposed to collect the Goods, we will deliver the Goods to you again, and you undertake to pay us all costs associated with the repeated delivery of the Goods at your request. If you breach your obligation to take over the Goods, except in the cases under point 6.4 of these Terms, this does not constitute a breach of Our obligation to deliver the Goods to you. At the same time, not taking over the Goods is not a reason for withdrawing from the Contract between Us and You. If you do not take over the Goods even within the additional period, We have the right to withdraw from the Contract due to your material breach of the Contract. If we decide to exercise this right, the withdrawal is effective on the day we deliver it to you. Withdrawal from the Contract does not affect the claim for compensation for damage in the amount of the actual costs of attempting to deliver the Goods at your request, or any other claim for damages, if incurred.
If, for reasons on your side, the Goods are delivered repeatedly or in a way other than agreed in the Contract, it is your obligation to reimburse Us for the costs associated with such repeated delivery at your request. We will send you the payment details for these costs to your e-mail address stated in the Contract, and they are due within 14 days of delivery of the e-mail.
The risk of accidental destruction, accidental deterioration and loss of the Goods passes to you at the moment the Goods are delivered. If you do not take over the Goods or refuse to take them over, except in the cases under point 6.4 of these Terms, the risk of accidental destruction, accidental deterioration and loss of the Goods passes to you at the moment you had the opportunity to take them over but did not do so for reasons on your side. The transfer of the risk of accidental destruction, accidental deterioration and loss of the Goods means that from that moment you bear all consequences associated with the loss, destruction, damage or any deterioration of the Goods.
RIGHTS ARISING FROM LIABILITY FOR DEFECTS
Introductory provision on liability for defects
If you are an Entrepreneur, we undertake to deliver the Goods to you in the agreed quality and quantity and free of defects.
If you are a Consumer, we undertake to deliver the Goods to you in accordance with the general requirements under § 617 of the Civil Code and the agreed requirements under § 616 of the Civil Code presented as the properties of the Goods you ordered on Our E-shop or in Our promotional materials relating to the supplied Goods, and free of defects. The Goods need not comply with the general requirements under § 617 of the Civil Code if, when concluding the Contract, we expressly informed you that a certain property does not meet such general requirements and you expressly and separately agreed to this.
The sold Goods comply with the general requirements under § 617 of the Civil Code if:
- they are suitable for all purposes for which Goods of the same type are normally used, taking into account in particular legislation, technical standards or codes of conduct applicable to the relevant sector, if no technical standards have been drawn up;
- they correspond to the description and quality of the sample or model that we made available to you before the Contract was concluded;
- they are delivered with the accessories, packaging and instructions, including assembly and installation instructions, that you can reasonably expect;
- they are delivered in the quantity, quality and with the properties, including functionality, compatibility, safety and the ability to maintain their functionality and performance in normal use (durability), that are normal for Goods of the same type and that you can reasonably expect given the nature of the sold Goods, taking into account any public statement made by us or by another person in the same supply chain, including the manufacturer, or on their behalf, in particular in advertising the Goods or on their labelling, where the manufacturer is the maker of the Goods, the importer of the Goods into the European Union market from a third country or another person who presents themselves as the manufacturer by placing their name, trademark or other distinguishing mark on the Goods. We are liable for defects that the Goods have at the time of delivery to the extent of Our obligation set out in Art. 7.1.1 or 7.1.2 of these Terms.
If you are an Entrepreneur, we are not liable for defects of the Goods in the following cases: if you were informed of existing defects or must have known about the defects from the circumstances of concluding the Contract and these defects do not conflict with the agreed properties of the Goods; if the defects of the Goods arose after you took over the Goods, provided that the defects did not arise as a result of a breach of Our obligations or you had the opportunity to take over the Goods under Art. 6 of these Terms and refused to take them over without legal reason or did not take them over; if you did not report obvious defects of the Goods in time under Art. 7.3.1 of these Terms; if you did not report hidden defects of the Goods in time under Art. 7.3.2 of these Terms; for used Goods, we are not liable for defects caused by their use or wear. For Goods sold at a lower price, we are not liable for the defects for which the lower price was agreed.
If you are a Consumer, we are not liable for defects and properties of the Goods in the following cases: if you did not report the defects of the Goods in time within the period stated in point 7.4.1 of these Terms; if the properties of the Goods do not meet the general requirements under § 617 of the Civil Code and you were clearly informed of this by Us in writing and separately gave your express written consent to such non-compliance; if it is a contract for the purchase of Goods with digital elements or a contract for the supply of digital content and the defects of the Goods arose as a result of incorrect installation or failure to install the necessary updates, provided that we ensured that such updates were supplied to you, informed you of their availability and of the consequences of not installing them, and the failure to install or incorrect installation of the necessary updates that caused the defects of the Goods was not caused by shortcomings in the installation instructions provided by Us.
The general warranty period is 24 months. The warranty period starts from the moment you take over the Goods.
If the Goods are replaced, the warranty period starts again from the moment you take over the new Goods.
Your rights arising from liability for defects of the Goods to which a warranty period applies expire if you do not exercise them within the warranty period. However, you must exercise rights arising from liability for defects of Goods that spoil quickly no later than the day following the purchase, otherwise your rights expire.
The sold Goods have defects if they do not comply with the agreed requirements and general requirements under the points above, or if their use is prevented or restricted by the rights of a third party, including intellectual property rights. We guarantee that at the time of transfer of the risk of accidental destruction, accidental deterioration and loss of the Goods under point 6.8 of the Terms, the Goods are free of defects, in particular that: they correspond to the description, type, quantity and quality and have the properties we agreed with you, and if these were not expressly agreed, then those we stated in the description of the Goods, or those that can reasonably be expected given the nature of the Goods;
They are suitable for the purposes we stated or for the purposes usual for Goods of this type and are functional; they have the defined ability to work with the hardware or software with which Goods of the same type are normally used without the need to change the sold Goods, hardware or software (compatibility), and the defined ability to work with hardware or software other than those with which Goods of the same type are normally used (interoperability);
They are delivered with all accessories and instructions, if so agreed with you in the Contract; the updates defined in the Contract are supplied, in the case of Goods with digital elements.
Conditions for exercising rights arising from liability for defects (complaints) specifically for Entrepreneurs
It is your obligation to report a defect without undue delay after you could have discovered it, but no later than 3 days from taking over the Goods.
You are obliged to exercise your right arising from liability for other (hidden) defects in the manner under point 7.5.1 below without undue delay after discovering the defect in the Goods, but no later than the end of the warranty period.
If the Goods are delivered to you in broken or damaged packaging, or the parcel is obviously too light, we ask you not to accept such Goods from the carrier and to notify us of this without delay on the telephone number 00420737648358 or by e-mail at podpora@vervoshop.com. If you discover obvious defects (e.g. mechanical damage), you are obliged to make a complaint without undue delay in the manner under point 7.5.1 below. We will not take into account a complaint about obvious defects of the Goods made later, including a defect consisting in the Goods being incomplete.
The warranty covers all defects of the Goods described in point 7.2 and/or contrary to our obligation in point 7.1.1a of these Terms.
You are not entitled to exercise the right arising from liability for a defect if we are not liable for the defects within the meaning of point 7.1.5 of these Terms or under the legislation valid and effective at the time the Contract was concluded, or if you knew about the defect before taking over the Goods, or we drew your attention to it, or you were given an appropriate discount on the Price of the Goods for that reason.
Conditions for exercising rights arising from liability for defects (complaints) specifically for Consumers
You are entitled to exercise your rights arising from liability for defects that occur in the received Goods within 2 months of discovering the defect, but no later than 24 months from delivery of the Goods. If the subject of the purchase is Goods with digital elements for which the digital content is to be supplied or the digital service provided continuously over an agreed period, we are liable for any defect of the digital content or digital service that occurs or becomes apparent during the entire agreed period, but at least 2 years from delivery of the Goods with digital elements.
If the Goods are delivered to you in broken or damaged packaging, or the parcel is obviously too light, we recommend that you do not accept such Goods from the carrier and notify us of this without delay on the telephone number 00420737648358 or by e-mail at podpora@vervoshop.com. If you decide to accept such a parcel, you must check the parcel in the presence of the carrier and make sure that no items of the Goods are missing and that all items of the Goods are in order. If, when checking the parcel under the previous sentence, you find that the condition or number of items of the ordered Goods does not correspond to what you ordered, we recommend that you draw up a Record of damage to the parcel with the carrier or note such a deficiency in the carrier's delivery protocol.
If you subsequently discover obvious defects after taking over the Goods (e.g. mechanical damage, missing Goods or items, incorrect Goods or items), we ask you to make a complaint without undue delay in the manner under point 7.5.1 below. We are entitled to reject a complaint about obvious defects of the Goods made later, including a defect consisting in the Goods being incomplete.
You are not entitled to exercise the right arising from liability for defects if we are not liable for the defects within the meaning of point 7.1.6 of these Terms or under the legislation valid and effective at the time the Contract was concluded.
You are entitled to exercise the right arising from liability for defects in the manner under point 7.5.1 and within the period stated in point 7.4.1 of these Terms.
Exercising rights arising from liability for defects (complaints)
If the Goods have a defect, i.e. in particular if any of the conditions under point 7.1 are not met, you can notify Us of such a defect and exercise your rights arising from liability for defects (i.e. make a complaint about the Goods) by sending an e-mail or a letter to Our addresses stated in Our identification details, or in person at Our premises, a list of which is available on our website. For the complaint, you can also use the model form provided by Us, which forms Annex No. 1 to these Terms.
In your notification making the complaint, state in particular a description of the defect of the Goods and your identification details, including the e-mail address to which you wish to receive notification of how the complaint has been handled, and also state which of the claims arising from liability for defects specified in points 7.6.3 to 7.6.8 you are making.
When making a complaint, also provide us with proof of purchase of the Goods (invoice) in order to prove that they were purchased from Us; otherwise we are not obliged to accept your complaint.
We consider the day of making the complaint to be the day the defective Goods are delivered together with the relevant documents (under point 7.5.3). If your submission making the complaint is incomplete (in particular illegible, unclear, incomprehensible, does not contain the required documents, etc.), we will ask you in writing, in particular by e-mail, to complete the complaint. In this case, the complaint procedure starts on the day your completed submission is delivered.
When we receive your complaint or your completion of the complaint, we will without delay issue you a written confirmation of receipt of the complaint or confirmation of the reported defect. In the confirmation, we will state the shortest possible period determined under point 7.6.1 within which we will remedy the reported defect of the Goods.
If you do not complete the complaint under point 7.5.4 of this article without undue delay, but no later than 10 days from the date of delivery of Our request under point 7.5.4 of this article, we will consider your submission unfounded, and if the requested missing information you were asked to provide is necessary for handling the complaint, we may decide not to deal with such an incomplete complaint.
Handling of complaints
Based on your decision as to which of the methods of remedying the defect specified in points 7.6.3 and 7.6.4 to 7.6.8 you are exercising, we will remedy the defect within a reasonable period that we need to assess the defect and to repair or replace the item, taking into account the nature of the item and the nature and seriousness of the defect, and which will not exceed 30 days from the date you made your complaint or reported the defect. We do not provide a consumer guarantee under § 626 of the Civil Code. We are not obliged to accept the method of remedying the defect you have chosen if that method is not possible or would cause us disproportionate costs, taking into account the Price of the Goods and the seriousness of the defect.
Only in exceptional cases and for objective reasons may we extend the period for remedying the defect stated in the confirmation of receipt of the reported defect by the shortest time necessary to remedy the defect. We will inform you in writing of such an extension of the period for remedying the defect.
If it is a defect that we can remedy by repair, you have the right to have the defect repaired free of charge, in good time and properly at Our expense.
Instead of having the defect remedied by repair, you can request replacement of the Goods.
Instead of remedying the defect of the Goods by repair, we can always replace the defective Goods with Goods free of defects, if this does not cause you serious difficulties.
After the period for remedying the defect has expired, you have the right to an appropriate discount on the Price of the Goods or you can withdraw from the Contract. You also have the same rights if we do not repair the defect or replace the Goods, refuse to repair or replace the Goods because repair or replacement is not possible or would require disproportionate costs, the Goods still have the same defects despite repair or replacement, or we inform you that the defect cannot be repaired or the Goods cannot be replaced within a reasonable period or without causing you serious difficulties. The discount on the purchase price must be proportionate to the difference between the value of the sold Goods and the value the Goods would have if they were free of defects. We will pay you the purchase price or the discount on the purchase price in the same way you used to pay the purchase price, unless we expressly agree on another method of payment. We bear all costs associated with the payment.
You cannot withdraw from the Contract under point 7.6.6 if you contributed to the defect or if the defect is negligible. If the Contract concerns several Goods, you can withdraw from the Contract only in relation to the defective Goods. In relation to the other Goods, you can withdraw from the Contract only if it cannot reasonably be expected that you will want to keep the other Goods without the defective Goods.
If it is a defect of the Goods that cannot be remedied and that prevents you from properly using the Goods as Goods without a defect, you have the right to replacement of the Goods or the right to withdraw from the Contract. You have the same rights if the defects are remediable but you cannot use the Goods properly because the defect recurs after repair or because of a larger number of defects.
We will handle your complaint or reported defect by handing over the repaired Goods, replacing the Goods, paying an appropriate discount on the Price of the Goods or by a written reasoned rejection of liability for the defects, i.e. by rejecting your complaint.
If you are a Consumer, the exercise of rights arising from liability for defects of the Goods is governed by § 619 et seq. of the Civil Code and by the Consumer Protection Act.
If we reject liability for the defects or reject your complaint, you have the right to turn to an accredited person, authorised person or notified person (e.g. an expert, an authorised, accredited or notified person, an authorised service centre, a scientific institution, etc.) to provide you with an expert opinion or professional statement proving Our liability for the defects of the Goods.
If you prove our liability for the defects of the Goods under point 7.8, you can report the defects of the Goods to us again, in which case we cannot reject this liability and will therefore be obliged to deal with your complaint again.
We bear the costs associated with obtaining an expert opinion or professional statement under point 7.8 of these Terms, but you must claim them from Us no later than 2 months after the repeated complaint has been handled.
We have hereby duly informed you of your rights related to exercising liability for any defects of the Goods.
By concluding the Contract, you confirm that you had the opportunity to read the terms for complaints about the Goods properly and in advance and that you understand them.
WITHDRAWAL FROM THE CONTRACT
Withdrawal from the Contract, i.e. termination of the contractual relationship between Us and You from its beginning, may occur for the reasons and in the ways stated in this article, or in other provisions of the Terms in which the possibility of withdrawal is expressly stated.
If you are a Consumer, in accordance with § 20 of the Consumer Protection Act you have the right to withdraw from the Contract without giving a reason within 14 days from the date of taking over the Goods, or from the conclusion of a Contract for the provision of a service, or from the conclusion of a Contract for the supply of digital content that we do not supply on a tangible medium. If we have concluded a Contract whose subject is several types of Goods or the delivery of several parts of the Goods, this period starts only on the day the last part of the Goods is taken over, and if we have concluded a Contract under which we will supply Goods to you regularly and repeatedly, it starts on the day the first delivery is taken over. You can withdraw from the Contract in any demonstrable way (in particular by sending an e-mail or a letter to Our addresses stated in Our identification details in the Terms). For the withdrawal, you can also use the model form provided by Us, which forms Annex No. 2 to the Terms. You are entitled to withdraw from the Contract also only in relation to a specific item or items of Goods, if we have delivered or provided several Goods under the Contract. The effects of withdrawal from the Contract also apply to any ancillary contract to the Contract, unless we expressly agree otherwise. After receiving the notice of withdrawal from the Contract, we will without delay provide you with Our confirmation of its receipt by e-mail or on a durable medium.
If you are a Consumer and we do not deliver the Goods to you in time, you are entitled to withdraw from the Contract even without granting an additional reasonable period under § 517(1) of the Civil Code if (i) we refuse to deliver the Goods to you, (ii) timely delivery was particularly important given all the circumstances of concluding the Contract, (iii) you informed Us before concluding the Contract that timely delivery is particularly important.
Even as a Consumer, however, you cannot withdraw from the Contract where the subject of the Contract is:
- the provision of a service, if the service has been fully provided and its provision began before the end of the withdrawal period with your express consent and you declared that you had been duly informed that by giving your consent you lose the right to withdraw from the Contract after the service has been fully provided, if you are obliged to pay the Price under the Contract;
- the sale of Goods whose Price depends on movements in prices on the financial market that we cannot influence and that may occur during the withdrawal period;

The withdrawal period under Art. 8.2 of the Terms is considered to have been observed if during it (but no later than on its last day) you send Us a notice that you are withdrawing from the Contract.
In the event of withdrawal from the Contract, the Price will be refunded to you within 14 days from the date of delivery of the notice of withdrawal to the bank account from which it was paid, or to the bank account you choose in the withdrawal. However, the amount will not be refunded before you return the Goods to Us or prove that they have been sent back to Us. Please return the Goods to Us clean, if possible including the original packaging.
In the event of withdrawal from the Contract under Art. 8.2 of the Terms, you are obliged within 14 days of the withdrawal to send the Goods to Us or hand them over to Us or a person authorised by Us to receive the Goods, and you bear the costs of returning the Goods to Us. This does not apply if we agree that we will collect the Goods in person or through a person authorised by Us. The period is observed if the Goods were handed over for transport no later than on the last day of the period. On the other hand, you are entitled to have the Shipping price refunded, but only in the amount corresponding to the cheapest method of delivery of the Goods that we offered. The first sentence of this point also applies to the return of a tangible medium on which Digital content was supplied to you under a Contract for the supply of digital content. After you withdraw from a Contract for the supply of digital content, we are also entitled to prevent you from further using the Digital content, in particular by restricting access to the Digital content or by cancelling your user account. If the subject of the Contract from which you are withdrawing is the provision of a service, you are obliged to pay Us the Price for the performance actually provided up to the day the notice of withdrawal is delivered, if you gave your express consent to the start of the provision of the service before it was provided.
You are liable for damage where the Goods are damaged as a result of your handling them in a way other than is necessary given their nature and properties. In such a case, we will invoice you for the damage caused after the Goods are returned to Us, and the invoiced amount is due within 14 days.
We are entitled to withdraw from the Contract due to stock running out, unavailability of the Goods, or if the manufacturer, importer or supplier of the Goods agreed in the Contract has interrupted production or made significant changes that made it impossible to fulfil Our obligations under the Contract, or for reasons of force majeure, or if, despite all the efforts that can fairly be required of Us, we are unable to deliver the Goods to you within the period set by these Terms. In these cases, we are obliged to inform you of this without undue delay and to refund the Total price already paid for the Goods within 14 days from the date of the notice of withdrawal from the Contract. We will refund the Total price paid for the Goods in the same way you paid it, without prejudice to the right to agree with you on another method of refund, provided that you are not charged any additional fees in connection with it.
We are also entitled to withdraw from the Contract if you do not take over the Goods within 5 working days from the day you became obliged to take them over.

FINAL PROVISIONS
We will deliver all written correspondence with you by e-mail. Our e-mail address is stated in Our identification details. We will deliver correspondence to your e-mail address stated in the Contract, in the User account or through which you contacted us.
The Contract can only be changed on the basis of our written agreement. However, we are entitled to amend and supplement these Terms; such a change will not affect Contracts already concluded, but only Contracts concluded after the change takes effect. We will inform you of the change only if you have a User account (so that you have this information when ordering new Goods; the change does not give rise to a right of termination, as we do not have a concluded Contract that could be terminated), or if we are to supply Goods to you regularly and repeatedly under the Contract. We will send you information about the change to your e-mail address at least 14 days before the change takes effect. If we do not receive from you, within 14 days of sending the information about the change, a termination of the concluded Contract for regular and repeated deliveries of Goods, the new terms become part of our Contract and apply to the next delivery of Goods after the change takes effect. If you give notice, the notice period is 2 months.
In the event of force majeure or events that cannot be foreseen (natural disaster, pandemic, operational failures, outages of subcontractors, etc.), we are not liable for damage caused as a result of or in connection with force majeure or unforeseeable events, and if this situation lasts longer than 10 days, both We and You have the right to withdraw from the Contract in writing.
An integral annex to the Terms is the model complaint form (Annex No. 1) and the model withdrawal form together with information (Annex No. 2).
The Contract, including the Terms, is archived electronically by Us, but is not accessible to you. However, you will always receive these Terms and the Order confirmation with the Order summary by e-mail, so you will always have access to the Contract even without Our cooperation. We recommend that you always save the Order confirmation and the Terms.
No codes of conduct under § 2(l) of the Consumer Protection Act apply to Our activities.
These Terms take effect on 1 December 2024.
